A federal judge in Delaware has finalized a ruling requiring Guardant Health to pay over $245.2 million to TwinStrand Biosciences and the University of Washington, cementing a November 2023 jury verdict that found Guardant willfully infringed two Duplex Sequencing patents.
Financial Penalties
The penalty covers willful infringement across 11 products and services that generated approximately 90% of Guardant Health's revenue during the period. The total award includes an initial $83.4 million jury verdict through mid-2023, $19.5 million in post-trial damages through early 2024, $119.4 million in court-ordered 6% royalty payments from now through May 2026, and $22.9 million in prejudgment interest.
Future Royalties and Patent Validity Confirmation
Going forward, the court requires Guardant Health to submit quarterly accounting reports and pay an ongoing 6% royalty on disputed products until the patents formally expire in March 2033.
Any unpaid judgment balance will continue to accrue interest. Earlier in the proceedings, the judge dismissed all counterclaims and rejected the defendant's attempts to secure a new trial.
The final legal order explicitly upholds the validity of both disputed patents. While separate administrative review proceedings remain ongoing at the U.S. Patent and Trademark Office, neither patent is currently subject to invalidation review.
