Munster Warns AI Agents Could Amplify Future Legal Risks

Gene Munster, managing partner at Deepwater Asset Management, views the current lawsuit as the early stage of broader legal challenges facing Meta. He roughly estimates the company could face around $25 billion in fines over five years but believes Meta can absorb these costs once its heavy capital expenditure cycle moderates and annual cash flow reaches an estimated $40 billion to $60 billion.

Munster sees a bigger long-term threat in CEO Mark Zuckerberg's pivot toward AI agents and "superintelligent bots." He believes these systems could exert greater influence over users, potentially exposing Meta to larger-scale litigation in the future.

He also views algorithm regulation as a risk, though he expects Meta to gradually replace its existing social media model with agent-based approaches over the next two to three years.

Allensworth Sees Higher Likelihood of Meta Losing

Rebecca Haw Allensworth, professor at Vanderbilt Law School, told CNBC she believes Meta is more likely than not to lose the current lawsuit, partly due to its track record in similar cases.

Allensworth said evidence that Meta designs products to maximize user engagement, combined with limited age and identity verification, could weigh against the company.

She believes Meta could still prevail on appeal, where Section 230 protections and First Amendment arguments could become significant and potentially reach the Supreme Court.

Her broader concerns center on Meta's business model. Since user engagement drives ad revenue, Allensworth believes restrictions on features like infinite scroll could reduce profitability and reshape how social media companies monetize.

Patel Sees Meta's Microsoft-Style Woes During AI Transition

Nilay Patel, editor-in-chief of The Verge, told CNBC the case could become Meta's version of Microsoft Corp.'s major antitrust litigation, forcing the company to defend its core business while navigating a major technology transition.

Patel believes restrictions on infinite scroll or young users' access to Instagram could hurt user engagement and ad revenue. Meanwhile, Zuckerberg is investing heavily in AI, personal superintelligence, and potential compute services.

Patel also thinks Meta's reputation for broad data collection could complicate its AI ambitions, particularly in developing products like smart glasses that collect information about users and their surroundings. In his view, Meta must manage mounting regulatory pressure while trying to establish itself as an AI leader.
